Terms and Conditions

These Terms and Conditions constitute a legally binding contract between you (the "Customer" or "you") and Sona Diamonds (ABN [insert ABN if available]), trading as Sona Diamonds ("we", "us", or "Sona Diamonds"). They govern the ordering, purchasing, production, and delivery of lab-grown diamond jewellery, customised engagement rings, wedding bands, and related items ("Products") purchased via our website at www.sonadiamonds.com.au or other approved methods.

By placing an order with Sona Diamonds, you agree to be bound by these Terms and Conditions.

Section 1: Your Rights as a Consumer

Purchases of our Products are subject to guarantees under the Australian Consumer Law (ACL). Under these laws, all Products must be of satisfactory quality, suitable for their intended purpose, and consistent with their description. If a Product has a significant fault, you may be entitled to a replacement, refund, or compensation for any reasonably foreseeable loss or damage. If a Product is not of satisfactory quality but the issue is not a major fault, you are entitled to have it repaired or replaced.

Section 2: Pricing and Taxes

Product prices are displayed on our website.

Sona Diamonds reserves the right to adjust prices at any time without prior notice.

Prices are quoted in Australian Dollars (AUD) and include Goods and Services Tax (GST) where applicable. You may be responsible for additional local taxes or duties applicable to your order.

Section 3: Orders

3.1 Placing an Order

To make a purchase, select your desired items, add them to your cart, proceed to checkout, and finalise your order.

By submitting an order, you acknowledge and agree that:

  • Your order is an offer to purchase Products at the price displayed at the time of submission, which Sona Diamonds may accept or reject at its sole discretion;
  • You have thoroughly checked your order details, as it may not be possible to cancel once we accept it;
  • An accepted order forms a binding agreement between you and Sona Diamonds for the supply of Products, subject to these Terms and Conditions;
  • All information you provide is accurate, complete, and truthful.

3.2 Offer and Acceptance

When you submit an order, you will receive an automated email acknowledging receipt. This does not confirm acceptance, even if payment has been processed. Your order represents an offer to purchase Products at the listed price.

All orders are subject to our approval. We may decline an order at our discretion, and you agree to pay for the Products if we accept your order.

Orders are not deemed accepted until processed and confirmed at our head office.

Acceptance creates a legally binding contract between you and Sona Diamonds for the supply of Products, in accordance with these Terms and Conditions.

In certain circumstances, Sona Diamonds may cancel an order after payment, including but not limited to:

  • Unavailability or discontinuation of a Product;
  • Errors in pricing or Product descriptions (as per Section 2 "Pricing and Taxes");
  • Website or technical issues affecting pricing during checkout;
  • Suspected fraudulent activity (see Section 3.3).

If cancellation occurs, we will contact you promptly to discuss options.

If we cancel an order after processing payment, we will provide a full refund.

Sona Diamonds reserves the right to correct errors and apologises for any inconvenience caused.

3.3 Payment for Orders

Payments are accepted via credit cards (contact us for accepted payment methods) or other approved options.

We may be unable to process or may decline payment for reasons including, but not limited to:

  • Discrepancies between the credit card or account name and the order name, or if the order or payment appears suspicious;
  • Alerts from our fraud detection systems;
  • Declined payments or suspected breaches flagged by your financial institution;
  • Expired credit cards.

In such cases, we may withhold order approval, place the order on hold, and request additional verification (e.g., proof of identity).

If we do not receive a response or the verification is unsatisfactory due to fraud concerns, we may cancel the order.

3.4 Cancellation of Orders

Sona Diamonds may cancel an accepted order prior to delivery for any reason, including those outlined in Clauses 3.2 or 3.3, or for reasons such as:

  • Errors on our website affecting technical details, descriptions, prices, or images, not identified before acceptance;
  • Inability of our suppliers to provide promised materials;
  • Uncontrollable events (e.g., natural disasters, fires, floods, earthquakes, acts of terrorism, power outages, or system failures) preventing timely delivery.

You may request cancellation only if:

  • Sona Diamonds breaches a material term of this agreement;
  • The order has not yet been accepted by us.

If we cancel an order, we will notify you via email (manually or automatically).

For cancelled orders where payment has been processed, we will refund the full amount paid.

Sona Diamonds is not liable for any loss, damage, cost, or expense arising directly or indirectly from order cancellation.

Section 4: Availability and Delivery

4.1 Product Availability

All Sona Diamonds Products are custom-made to order. Production may take up to 50 business days, depending on the item, with potential extensions during peak periods. While we strive for prompt delivery, delays may occur, and we cannot guarantee fixed delivery times or constant stock availability.

For precise information about a specific item, please contact us directly.

You acknowledge and agree that:

  • Delivery timelines vary depending on the Product;
  • Estimated delivery times are indicative only and may be extended;
  • Delays may occur during high-demand periods;
  • Sona Diamonds is not responsible for any loss, damage, cost, or expense caused directly or indirectly by delays in delivery.

4.2 Delivery

Risk and ownership of Products transfer to you upon delivery to the address you provided. A signature may not be required upon delivery.

After dispatching your Products, we will send a confirmation email with tracking details.

You may need to sign for delivery. If you are unavailable, the package may be redirected to a nearby postal facility for collection.

If a package is returned due to an incorrect address you provided or failure to collect within a reasonable timeframe, we may attempt redelivery. A reasonable redelivery fee may apply, subject to your prior approval.

Section 5: Refunds

Where Sona Diamonds is obligated to refund your payment under these Terms and Conditions, you acknowledge and agree that:

  • We aim to process refunds within 2 business days during business hours, unless otherwise stated;
  • Refunds may be processed in instalments of $1000 AUD, in line with banking procedures;
  • The time taken to receive your refund depends on your financial institution’s processing speed.

Section 6: Non-Payment

If you fail to make the final payment within 28 days of being notified that your Product is complete, Sona Diamonds reserves the right to sell or repurpose the item to recover costs. This is a last resort, and we will provide multiple opportunities for payment before taking such action.

Section 7: Uncollected Products

If you fail to arrange collection or delivery of your completed Product within 28 days of notification, we will issue a final reminder. If no response is received within 90 days, Sona Diamonds may dispose of the Product.

Section 8: Returns

At Sona Diamonds, we are committed to delivering expertly crafted lab-grown diamond jewellery and custom pieces designed to endure. Each Product undergoes rigorous quality assurance to ensure exceptional standards.

Product Returns

Due to the made-to-order and customised nature of our Products, we do not offer refunds or returns unless the item is faulty or damaged due to a manufacturing defect (refer to our Lifetime Warranty for details). Please contact us with any queries regarding returns.

Returns Procedure

Please review our Lifetime Warranty and Terms and Conditions before purchasing to fully understand our policies. If you believe your Product is eligible for a return due to a manufacturing fault, follow the steps below.

How to Return a Faulty or Damaged Product

  • Contact us via our contact form, and a team member will guide you through the process.
  • After discussion, we will arrange for the Product to be returned for assessment via post. Returns must include the original packaging, all accompanying materials (e.g., packing slip, stone certificates), a copy of the invoice, and a note with your contact details. Failure to package correctly may result in a partial refund, as we are not liable for improper packaging.
  • A postage deposit of $40 AUD (within Australia) or $200 AUD (international) is required for two-way shipping. If the damage is not covered by our warranty, we will provide a repair quote for your approval. If you choose not to proceed with the repair, the deposit will cover return shipping. If the issue is a manufacturing defect, the deposit will be fully refunded, and repairs will be completed at no cost.
  • Please review our Lifetime Warranty to understand what is and is not covered, as the postage deposit is non-refunded for non-warranty issues.
  • We will perform a complimentary assessment to determine if the damage is covered by the warranty.

Refund Procedure

Upon receiving your return, our jewellers will evaluate the Product’s condition and documentation, which takes 1–5 business days. If the Product qualifies for a return or refund due to a manufacturing fault, we will process a refund to your original payment method.

Section 9: Customisation

We offer limited customisation options for engagement rings, wedding bands, and other jewellery, including choices of metal types, stone sizes, engravings, and select design elements. While we aim to bring your vision to life, all customisation requests are subject to our approval to ensure the Product’s durability and structural integrity.

Our team may recommend or require adjustments to your design to safeguard the Product’s longevity and security (e.g., settings to protect stones). These suggestions are made to ensure the jewellery remains durable for a lifetime. We will not proceed with designs that compromise the Product’s quality.

For custom orders, we provide design renderings or prototypes for your review. Once you approve the final design in writing or via email, the order is final, and no further changes are permitted. We allow up to two complimentary design revisions; additional revisions may incur a fee. We reserve the right to decline customisation requests that are impractical or risk Product quality.

Section 10: Privacy

Our collection, use, and disclosure of personal information are governed by our Privacy Policy, which forms part of these Terms and Conditions.

Your use of our website is subject to these Terms and Conditions.

Sona Diamonds may amend these Terms and Conditions at any time without notice. Amendments are effective upon posting on our website.

Lifetime Warranty for Sona Diamonds

At Sona Diamonds, we are dedicated to creating lab-grown diamond jewellery and custom pieces with exceptional craftsmanship, designed to be cherished for a lifetime. Every piece undergoes thorough quality checks to ensure the highest standards of quality and durability.

Australian Consumer Law

Our Products come with guarantees under the Australian Consumer Law (ACL). If a Product has a minor fault, you are entitled to a free repair. For major faults with our Products or services, following an assessment by Sona Diamonds, you may be eligible to:

  • cancel your service contract and receive a refund for any unused portion or compensation for its reduced value;
  • have the issue rectified within a reasonable time frame;
  • receive compensation for any reasonably foreseeable loss or damage caused by the fault.

Exceptions to Consumer Guarantees

ACL guarantees do not apply if you:

  • received the Product as ordered but changed your mind, found a better price elsewhere, disliked the purchase, or found no use for it;
  • caused the issue through misuse or mishandling of the Product;
  • requested a specific customisation against our professional advice or were unclear about your requirements;
  • were informed of any faults prior to purchase.

Lifetime Manufacturing Warranty

Sona Diamonds provides a lifetime warranty on all Products against manufacturing defects in materials and workmanship, effective from the date of purchase. This warranty covers free repairs or replacements for verified manufacturing faults, subject to our inspection.

What is Covered by the Lifetime Manufacturing Warranty?

The warranty applies to defects in the construction or materials of the jewellery, typically evident within the first few months of use. Examples of covered manufacturing defects include:

  • Surface imperfections or porosity in the metal (e.g., visible blemishes or irregularities);
  • Faulty settings identified upon delivery or during a professional inspection by Sona Diamonds;
  • Scratches, chips, or damage to stones present at the time of delivery or during servicing with us;
  • Discolouration or staining of the metal (e.g., rhodium plating issues) identified at delivery or during servicing with us.

What is Not Covered by the Lifetime Manufacturing Warranty

The warranty does not cover damage or issues resulting from:

  • Normal wear and tear, including scratches, dents, or abrasions on metal settings. Precious metals are malleable and may show signs of wear over time;
  • Damage to gemstones (e.g., chips, cracks, or scratches) caused by impact, accidents, or wear, as even lab-grown diamonds, while extremely hard, can be damaged if struck at vulnerable points (e.g., edges or girdles);
  • Corrosion or pitting of metal due to exposure to harsh chemicals (e.g., chlorine, cleaning agents, or cosmetics);
  • Discolouration of metal from exposure to chemicals, makeup, swimming pools, or hot tubs;
  • Thinning of prongs, bands, or other metal components due to prolonged wear;
  • Bent or damaged prongs caused by everyday activities, leading to stone loss;
  • Loss or theft of gemstones or the Product itself due to wear, accidents, or other damage;
  • Modifications, repairs, or servicing performed by anyone other than Sona Diamonds;
  • Cosmetic changes or personal preferences unrelated to manufacturing defects.

Claiming Your Lifetime Manufacturing Warranty

To make a warranty claim, follow these steps:

  1. Contact us via our contact form, and a team member will assist you.
  2. After discussion, we will arrange for the Product to be returned for assessment via post. Returns must include:
    • The original packaging and all accompanying materials (e.g., packing slip, stone certificates);
    • A copy of the invoice and a note with your contact details.

Jewellery Care Recommendations

To preserve the longevity and beauty of your jewellery, we recommend:

  • Removing your jewellery during hands-on activities, such as sports, gym workouts, or heavy housework (e.g., gardening, dishwashing);
  • Using creams and moisturisers before putting on the jewellery;
  • Putting on jewellery last when getting ready and removing it first when returning home;
  • Scheduling annual professional inspections and cleanings with Sona Diamonds to ensure settings remain secure and the piece stays in optimal condition.
